Proposed new definitions for plan variances and amendments, in line with the UFA.
The description of variance in the Peel Plan does not align with the wording in UFA Section. 12.17.5. A variance should refer to an allowance for a non-conforming use. It is not meant to be a form of plan amendment.
The 2019 approved plan states that a Plan Variance is “when the Plan needs minor changes.” And that an Amendment is “when the plan needs alterations to its management strategies”
However, the UFA uses the term “variance from a regional land use plan”, not a variance to a land use plan. Therefore, it is not mandatory to make a change to the plan to reflect approval of a non-conforming use. It is simply considered a variance from the plan and should be documented.
