In 2022, the Peel Plan Implementation Committee (PPIC) provided standard terms and conditions to be applied to development activities in the Peel Watershed. These terms and conditions are meant to be consistent with the plan.
Specific Plan Adjustments
Section 6.0 Plan Implementation & Revision and Appendix C: Summary of Recommendations
Page(s): 125-127
Details:
Standard terms and conditions were not a recommendation of the regional land use plan.
Subsequent to approval of the plan, PPIC determined that it was important to clarify standards that apply to industrial developments. PPIC’s implementation plan included the following action: “Develop document(s) describing standard terms and conditions (STC) to apply to mining, oil and gas exploration, and industrial development in IMAs and Conservation Areas (i.e. grandfathered claims), to ensure conformity to the Plan”.
Specific Amendments
1. Add the Standard Terms & Conditions to the plan as “Appendix H”.
2. Add the following text related to section 6.
Standard Terms and Conditions
The Peel Watershed Standard Terms and Conditions (See Appendix H) are meant to be applied to development activities throughout the Peel Watershed. Each of the following groups have a role to play in the implementation of these terms and conditions.
Developers: Before a proponent is bringing forward to YESAB for review, they should be reviewing the terms and conditions and making best efforts to apply these to their project.
Commission or Council: When conducting conformity checks (regional planning commission) or consistency opinions (Yukon Land Use Planning Council), the commission/council will apply the standard terms and conditions as a preliminary review, and will conduct a more fulsome review of the project in respect to the plan. Where there are any discrepancies, the Peel Watershed LUP takes precedence.
Assessors: The YESAB designated office will take into account the conformity check and where a project is deemed not to be in conformity, will recommend mitigations to the proponent that would bring the project into conformity.
Decision Bodies: The decision body will take into account the terms and conditions, the conformity check, and the YESAB DO recommendations in making the final decision about proposed projects.
Document Status: Unchanged
